In Home Healthcare Planning is a type of legal service designed to help clients who wish to remain in their homes, avoiding the transition to a Long Term Care Facility. Sometimes remaining in the home is the best option for illness recovery, rehabilitation, and continuing an independent lifestyle. When the choice is made to receive care in the home, our office serves as a guide through the Asset preservation process. Often, this type of planning may involve coordination with such organizations as Aging and In Home Services and the Indiana Medicaid Waiver Services program.

In his practice Gerret helps clients form plans that assist them in preserving assets and remaining independent in the community for as long as this is possible. However, in the event their health declines, it is sometimes not possible for the client to remain safely at home. In these cases, Mr. Swearingen can also assist clients in preserving the family resources from the high costs of skilled nursing facility care. Often, the goal of preserving resources can be achieved, while likewise insuring that the healthcare needs of the client are met. This allows the client to achieve the best quality of life possible for both the client and his or her spouse and children while preserving the Client assets.
Mr. Swearingen graduated from Canterbury High School, received a B.A. degree in Literature from Depauw University, and a Doctor of Jurisprudence from Valparaiso University School of Law.Mr. Swearingen is a member of the Elder Law Section of the Indiana State Bar Association and has been admitted to practice before both State and Federal Courts. He is a member of the National Academy of Elder Law Attorneys (NAELA), and belongs to the Sigma Nu social Fraternity.

Medicare
Medicare provides health coverage to those over age 65 (or under 65 but disabled). However, Medicare generally does not cover nursing home care or, if so, only for the short term. That’s where Medicaid comes in.
